Terms and Conditions

Effective Date: August 13, 2026

These Terms and Conditions (“Terms,” “Terms and Conditions”) govern your use of the website https://www.drtsaiplasticsurgery.com/ (the “Website”) and your participation in any text messaging/SMS program offered by Roger Tsai M.D., Inc. (“Dr. Tsai Plastic Surgery,” “we,” “us,” or “our”).

By accessing or using the Website, submitting information through the Website, or voluntarily enrolling in our SMS/text messaging program, you agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use the Website or enroll in our SMS/text messaging program.

  1. Website Use

The Website provides general information about Roger Tsai M.D., Inc., our physicians, procedures, services, and ways to contact or request an appointment with our practice.

Information provided on the Website is for general informational and educational purposes only. The Website is not intended to provide medical advice, diagnosis, or treatment.

You should consult a qualified healthcare professional regarding your individual medical needs and circumstances.

  1. No Doctor-Patient Relationship Through the Website

Submitting a form, requesting information, communicating through the Website, sending an email, or communicating by text message does not by itself establish a doctor-patient relationship.

Do not use website forms, email, or SMS/text messaging to submit information regarding a medical emergency or other urgent medical condition.

If you are experiencing a medical emergency, call 911 or seek immediate medical attention.

  1. Medical Information and HIPAA

Medical and health information may be subject to additional protections under applicable healthcare privacy laws, including the Health Insurance Portability and Accountability Act (“HIPAA”).

Our Notice of Privacy Practices/HIPAA Privacy Policy describes how protected health information may be used and disclosed and describes applicable patient rights.

These Terms and Conditions should be read together with our Privacy Policy and HIPAA Notice of Privacy Practices.

  1. Age Restriction

The Website may contain information regarding medical and cosmetic procedures that are intended primarily for adults.

You must be at least 18 years old to voluntarily enroll in or provide consent for our SMS/text messaging program.

By checking an SMS consent box, submitting your mobile telephone number for SMS enrollment, or otherwise opting in to receive text messages from us, you represent and warrant that:

  • You are at least 18 years old;
  • The mobile telephone number you provide belongs to you or you are authorized to provide consent for that number;
  • You are authorized to consent to receive text messages at the telephone number provided; and
  • The information you provide is accurate and complete.

If you are under 18, do not enroll in our SMS/text messaging program or provide SMS consent.

Nothing in this age restriction is intended to prevent a parent, guardian, or other legally authorized person from contacting our practice regarding medical services for a minor where permitted by applicable law and our practice policies.

We may refuse or terminate SMS enrollment if we have reason to believe that the person providing consent does not meet the applicable age or authorization requirements.

  1. SMS/Text Messaging Program

If you voluntarily opt in to receive SMS/text messages from Roger Tsai M.D., Inc., you agree to receive text messages at the mobile telephone number you provide.

Depending on the type of consent you provide, messages may include:

  • Appointment reminders;
  • Consultation-related communications;
  • Scheduling or rescheduling information;
  • Patient/customer service communications;
  • Responses to inquiries;
  • Information related to requested services; and/or
  • Other communications for which you have separately provided appropriate consent.

Message frequency: Message frequency varies.

Message and data rates may apply.

Your mobile carrier may charge you for text messages or data according to your wireless plan.

  1. SMS Consent Is Voluntary

SMS/text messaging consent is voluntary.

Consent to receive SMS/text messages is not a condition of purchasing goods or services, scheduling an appointment, receiving medical care, or using the Website.

You may request information, contact our practice, or use available services without agreeing to receive promotional SMS messages.

SMS consent must be provided separately from your acceptance of these Terms and Conditions and separately from our Privacy Policy.

A general agreement to these Terms does not constitute SMS consent.

  1. Separate SMS Opt-In

Where SMS consent is requested through a website form, the SMS consent checkbox or other consent mechanism should be separate from acceptance of these Terms and Conditions and should not be selected by default.

An example of an SMS consent statement is:

“☐ I agree to receive text messages from Roger Tsai M.D., Inc. regarding appointments, consultations, and related communications. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchasing goods or services. Reply STOP to opt out and HELP for help. View our Privacy Policy and Terms & Conditions.”

You should only check the SMS consent box if you want to receive text messages.

  1. Opting Out of SMS Messages

You may opt out of SMS/text messages at any time.

To stop receiving messages, reply:

STOP

After you send STOP, you may receive a confirmation message, and you will no longer receive SMS messages from the applicable messaging program except where permitted or required by law.

You may also contact our office directly to request assistance with your messaging preferences.

  1. SMS Consent and Mobile Information

We respect the privacy of individuals who provide mobile telephone numbers and SMS consent.

We do not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent information with third parties or affiliates for their own marketing or promotional purposes.

We may disclose or provide access to information to service providers that assist us with operating our business and delivering requested communications, including telecommunications, messaging, scheduling, technology, customer-service, security, and related services.

Such service providers may process information only as reasonably necessary to provide services to us and are not authorized to use SMS consent or mobile information for their own independent marketing purposes.

For additional information, please review our Privacy Policy.

  1. No Transfer of SMS Consent

Your SMS consent is specific to Roger Tsai M.D., Inc. and the messaging program for which you provided consent.

Your consent is not transferable to another company or unrelated third party.

We will not treat consent provided for one messaging purpose as consent for an unrelated messaging campaign.

For example, consent to receive appointment-related messages does not automatically constitute consent to receive promotional or marketing messages.

Where required, separate consent will be obtained for separate messaging purposes.

  1. Message Frequency

Message frequency varies.

The number of messages you receive may depend on your appointments, inquiries, requested services, communications with our office, and the type of SMS program for which you have opted in.

You may opt out at any time by replying STOP.

  1. Carrier and Wireless Provider Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery may be affected by your wireless carrier, network availability, device compatibility, geographic location, or other circumstances outside our reasonable control.

We do not guarantee that every SMS message will be delivered immediately or successfully.

  1. Website Content

We make reasonable efforts to provide accurate and current information on the Website. However, we do not guarantee that all information is complete, current, accurate, or free from errors.

Information regarding procedures, results, risks, recovery, pricing, availability, and other services may change.

Before making a medical decision, you should discuss your individual circumstances with a qualified healthcare professional.

  1. Before-and-After Photographs

Before-and-after photographs and other images displayed on the Website are provided for informational purposes.

Individual results may vary. Photographs are not a guarantee or representation that another patient will achieve the same or similar results.

  1. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, or services.

We do not control and are not responsible for the content, availability, privacy practices, security, or terms of third-party websites or services.

Your use of third-party websites is subject to the terms and policies of those third parties.

  1. Website Communications and Security

Internet communications, including website forms and ordinary email, may not be completely secure.

You acknowledge that electronic communications may carry risks of unauthorized access or interception.

Please do not submit sensitive medical information through an ordinary website form, email, or SMS message unless we have specifically instructed you to do so through an appropriate secure method.

  1. Prohibited Use

You agree not to:

  • Use the Website for an unlawful purpose;
  • Attempt to gain unauthorized access to the Website or its systems;
  • Interfere with the operation or security of the Website;

  1. Intellectual Property

Unless otherwise indicated, the content of the Website, including text, graphics, photographs, logos, design elements, and other materials, is owned by or licensed to Roger Tsai M.D., Inc. and may be protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, transmit, sell, or otherwise exploit Website content without prior written permission, except as permitted by applicable law.

  1. Privacy

Your use of the Website and our services is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, and protect personal information.

Our Privacy Policy is available on our Website and should be reviewed together with these Terms and Conditions.

  1. Changes to These Terms

We may modify these Terms and Conditions from time to time.

Changes will become effective when the revised Terms are posted on the Website unless a different effective date is stated.

Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Changes to SMS consent practices will not automatically create SMS consent where separate consent is required.

  1. Termination of SMS Enrollment

We may suspend or terminate your participation in an SMS messaging program if:

  • You opt out;
  • Your mobile number is disconnected or reassigned;
  • We reasonably believe that your consent was not validly obtained;
  • We discontinue the applicable messaging program;
  • We are required to do so by law, regulation, carrier requirements, or messaging-platform requirements; or
  • Your participation violates these Terms.

Termination of SMS enrollment does not necessarily terminate other communications that we are legally permitted or required to provide.

  1. Limitation of Liability

To the extent permitted by applicable law, Roger Tsai M.D., Inc. and its physicians, employees, contractors, affiliates, and service providers will not be liable for losses arising from unauthorized access, telecommunications failures, network interruptions, delayed SMS messages, third-party services, or other events outside our reasonable control.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.
